Terms of Use — ChokChok

1. Acceptance of Terms

By downloading, installing, and using ChokChok ("App"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree to these Terms, do not use the App. The developer, Yohei Onishi ("Developer," "we," "us," "our"), reserves the right to modify these Terms at any time. Your continued use of the App after any changes constitutes your acceptance of the new Terms.

2. App License & Use

We grant you a limited, non-exclusive, non-transferable, revocable license to use the App on your iOS device for personal, non-commercial purposes. You may not:

Copy, modify, or create derivative versions of the App
Reverse engineer, decompile, or attempt to extract the source code
Rent, lease, lend, or resell the App
Remove or alter any copyright, trademark, or proprietary notices
Use the App for any illegal or unauthorized purpose

3. In-App Purchases

ChokChok is free of charge and contains no in-app purchases and no subscriptions. Every feature of the App is available to every user at no cost. We do not collect payment information, and there is nothing to cancel.

4. Apple's Standard EULA

Your use of the App is also governed by Apple's Standard End User License Agreement as it pertains to apps distributed through the App Store. In case of any conflict between these Terms and Apple's EULA, the most restrictive terms apply. Apple is not responsible for the App or its content and does not provide support for the App.

5. Disclaimer of Medical Advice

                IMPORTANT: ChokChok is a self-care companion and routine tracker. It is NOT medical advice, a medical treatment, or a replacement for professional dermatology consultation. Always consult with a dermatologist or healthcare provider before starting any new skincare routine, especially if you have sensitive skin or underlying skin conditions.
            

6. Limitation of Liability & Disclaimers

THE APP IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND. To the maximum extent permitted by law:

We disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement
We are not liable for any indirect, incidental, consequential, or punitive damages, even if advised of the possibility of such damages
We are not responsible for data loss, device malfunction, or interruptions in service
Your use of the App is at your own risk

Some jurisdictions do not allow limitation of liability, so these limitations may not fully apply to you.

7. Data Ownership & Device Storage

All data you create in the App (routines, photos, product information, etc.) is your property. The App stores all data on your device only. You are responsible for backing up your data. If you uninstall the App, all data associated with the App will be deleted and cannot be recovered by the Developer. The Developer is not responsible for any data loss.

8. Prohibited Conduct

You agree not to:

Use the App for any illegal or unauthorized purpose
Violate any local, state, or international laws
Violate Apple's App Store terms and guidelines
Interfere with or disrupt the App's functionality
Attempt to gain unauthorized access to the App or its systems

9. Intellectual Property Rights

The App, including all content, design, graphics, text, and code, is the intellectual property of Yohei Onishi. All rights are reserved. You may not use any part of the App for commercial purposes without written permission.

10. Governing Law & Jurisdiction

These Terms are governed by the laws of Japan, without regard to conflict of law principles. You agree to submit to the exclusive jurisdiction of the courts located in Japan for any disputes arising from these Terms or your use of the App.

11. Entire Agreement

These Terms, along with our Privacy Policy and any other policies posted on our websites, constitute the entire agreement between you and the Developer regarding your use of the App. If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

12. Severability

If any provision of these Terms is deemed invalid, illegal, or unenforceable by a court of competent jurisdiction, that provision will be severed, and the remaining provisions will remain in effect to the fullest extent permitted by law.
